Inquiry into a sample irregularity – Apprentice Jockey K W Leung
The Stewards today concluded their inquiry into the analyst's report on the urine sample supplied by Apprentice Jockey K W Leung, as directed by the Stewards, at the Sha Tin race meeting conducted on Sunday, 5 September 2010. Evidence was today taken from Apprentice Leung, Mr Y S Tsui, the allocated trainer of Apprentice Leung, and Dr T S M Wan, the Club's Head of Racing Laboratory.
Dr Wan reported on 8 September 2010 that the sample supplied by Apprentice Leung which he analysed contained ketamine. Ketamine is a prohibited substance (jockey) in accordance with the Rules of Racing of The Hong Kong Jockey Club.
Apprentice Leung today pleaded guilty to a charge of having breached Hong Kong Jockey Club Rule of Racing 60(1) in that the sample supplied by him, as directed by the Stewards, at the Sha Tin racemeeting on 5 September 2010 had upon analysis shown the presence of ketamine and norketamine, a metabolite of ketamine. The Stewards decided in the circumstances of this case the appropriate penalty was for Apprentice Leung’s jockey’s licence to be suspended for a period to expire on 8 March 2011 on which day he may resume riding. The commencement of this suspension was back dated to 8 September 2010 on which day Apprentice Leung was stood down from riding by order of the Stewards. Apprentice Leung was advised that he must provide a clear sample prior to resuming riding.
The Hong Kong Jockey Club conducts a comprehensive jockey testing regime in order to identify the presence of prohibited substances. This testing programme is in place so the Club is able to fulfil its duty of care to ensure where possible that the safety and welfare of human and equine industry participants is not compromised. This testing regime includes the requirement under the Rules of Racing for jockeys riding in Hong Kong to supply or allow to be taken samples of their breath, blood, urine or other body fluids for testing by the Club’s Racing Laboratory.
